Where things stand

As of 3 November 2026, an injunction protects ANJ, ABERT and ANER members against unauthorised collection and account penalties. A final judgment remains pending.

Brazilian injunction limits Meta’s collection of news content for AI

A São Paulo judge on 3 November 2026 suspended clauses allowing Meta to collect content without permission from outlets belonging to three Brazilian media associations, including for AI training. The measure is provisional.

ANJ, ABERT and ANER challenged new commercial terms due to take effect on 20 November. The order also requires Meta to keep the affected outlets’ Facebook, Instagram, WhatsApp and Threads accounts active, without penalties for rejecting the terms.

Non-compliance carries a daily fine of 1 million reais, capped at 100 million. AFP, which inspected the injunction, reports that Meta has five days after notification to present its defence. Protection covers members of the applicant associations; this is not a final judgment on AI use generally.
