Taiwan parliament allows death penalty for certain repeat fatal drug-driving offences

Taiwan's parliament passed a criminal code reform on 30 October 2026 allowing the death penalty for a repeat drug-driving offence causing a death within ten years. Capital punishment becomes a sentencing option, rather than an automatic sentence.

The legislation amends Article 185-3 and separates drug-driving penalties from those for alcohol-impaired driving. For the repeat fatal offence concerned, it provides for death, life imprisonment or a prison term of at least ten years.

The reform also raises the minimum prison term for drug-driving causing death to seven years, from a previous range of three to ten years. It therefore stiffens several levels of penalties beyond the capital punishment provision.

Reporting by CNA and United Daily News establishes parliamentary passage. It does not establish here that promulgation is complete or that these new penalties have already taken effect.
